Terms of Service

Welcome to Fylio! These Terms of Service (“Terms”) govern your use of the Fylio platform available at fylio.com (“Service”), operated by Individual Entrepreneur Shabashov Dmitry Viktorovich (OGRNIP: 325632700075291, INN: 632313025242) (“we,” “us,” or “Company”).

By creating an account or using the Service, you confirm that you are at least 16 years old and agree to these Terms. If you do not agree, please do not use the Service.

1. About Fylio

Fylio is a file hosting platform that allows users to upload, store, share files. The Service includes free and paid storage plans.

2. Your Account

2.1. Registration. To access most features, you need to create an account with a valid email address. You are responsible for keeping your login credentials secure and for all activity under your account.

2.2. One Account Per Person. Each individual may maintain only one account. Creating multiple accounts to exploit free storage is prohibited and may result in suspension or termination of all associated accounts.

2.3. Accurate Information. You agree to provide accurate and up-to-date information during registration and to update it as needed.

3. Storage Plans & Limits

3.1. Free Plan. Every account receives up to 50 GB of storage. The maximum size of a single uploaded file is 10 GB.

3.2. Premium Subscription. We offer a paid Premium plan with additional storage, faster download speeds via extended CDN coverage, and other benefits. Premium pricing varies by region and is displayed at the time of purchase.

3.3. Auto-Renewal. Premium subscriptions renew automatically at the end of each billing cycle. You can manage or cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

3.4. Refunds. If you are located in the European Union or the United Kingdom, you have the right to cancel your subscription within 14 days of purchase for a full refund, provided the Service has not been substantially used during that period. For users in other regions, we offer a 7-day refund window under the same conditions. To request a refund, contact us at support@fylio.com. Refunds for partially used billing periods may be issued at our discretion on a pro-rata basis.

4. Acceptable Use

4.1. Permitted Content. You may upload any content that is legal in your jurisdiction and does not violate these Terms.

4.2. Prohibited Content. You may not upload, share, or distribute:

  • Content that violates applicable laws or regulations
  • Child sexual abuse material (CSAM) or any content that exploits minors
  • Malware, viruses, trojans, ransomware, or any malicious software
  • Content that infringes on copyrights, trademarks, or other intellectual property rights without authorization
  • Content that promotes terrorism, violence, or incites hatred
  • Personal or private information of others without their consent (doxxing)

4.3. Enforcement. We reserve the right to remove any content and suspend or terminate any account that violates these Terms, without prior notice. We cooperate with law enforcement where required by applicable law.

5. Copyright & DMCA

5.1. Respect for Intellectual Property. Fylio respects the intellectual property rights of others and expects its users to do the same.

5.2. Reporting Infringement. If you believe your copyrighted work has been uploaded without authorization, you may submit a takedown request by using the report button on the file page or by contacting abuse@fylio.com. Please include:

  • Identification of the copyrighted work
  • The URL of the infringing file on Fylio
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement under penalty of perjury that the information is accurate and you are the rights holder or authorized to act on their behalf

5.3. Counter-Notice. If you believe your content was removed in error, you may submit a counter-notice to abuse@fylio.com with an explanation and your contact details. We will process counter-notices in accordance with applicable law.

5.4. Repeat Infringers. We may terminate the accounts of users who repeatedly infringe on intellectual property rights.

6. Payments

6.1. Payment Methods. We accept payments through Stripe, YooKassa (for users in Russia and CIS), and cryptocurrency. Payment processing is handled by third-party providers, and your use of their services is subject to their respective terms.

6.2. Payments in Russian Rubles. Payments in Russian rubles are processed through YooKassa for users in Russia and CIS countries.

6.3. Pricing. Prices for Premium subscriptions and other paid features are displayed in your local currency where possible. We reserve the right to change pricing with reasonable notice.

6.4. Taxes. You are responsible for any applicable taxes related to your use of the Service.

7. Intellectual Property

7.1. Your Content. You retain ownership of all files you upload to Fylio. By uploading content, you grant us a limited, non-exclusive license to store, process, and deliver your files as necessary to operate the Service.

7.2. Our Service. Fylio, including its design, code, features, and branding, is owned by Individual Entrepreneur Shabashov Dmitry Viktorovich. You may not copy, modify, or reverse-engineer any part of the Service.

8. Limitation of Liability

8.1. No Warranty. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation.

8.2. No SLA. We do not provide a service-level agreement or uptime guarantees. While we strive for high availability, temporary downtime may occur for maintenance, updates, or unforeseen circumstances.

8.3. Liability Cap. To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

8.4. Data Loss. While we take reasonable measures to protect your data, we are not liable for any loss of files or data. You are responsible for maintaining your own backups.

9. Account Termination

9.1. By You. You may delete your account at any time through your account settings. Upon deletion, your files will be removed from our servers within a reasonable timeframe.

9.2. By Us. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if your account remains inactive for an extended period. We will make reasonable efforts to notify you before termination, except in cases of serious violations.

9.3. Effect of Termination. Upon termination, your right to use the Service ceases. Files associated with your account may be deleted.

10. Modifications to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Russian Federation. Any disputes arising from these Terms shall be resolved through the courts of the Russian Federation, unless otherwise required by the mandatory consumer protection laws of your country of residence.
